各省、自治區住房和城(cheng)鄉建(jian)設廳,直轄市住房和建(jian)設(管)委,新疆生產(chan)建(jian)設兵團住房和城(cheng)鄉建(jian)設局,有關行業(ye)協會,有關中央企業(ye):

為(wei)深入貫(guan)徹習(xi)近平總書記(ji)在統籌推(tui)進新冠肺炎(yan)疫(yi)情(qing)防控和(he)經(jing)濟社會(hui)發展工(gong)作部(bu)署會(hui)議(yi)上(shang)的重要講話精神,認(ren)真(zhen)落(luo)實黨中央、國務院有(you)關決策部(bu)署,加(jia)強(qiang)房屋建(jian)筑和(he)市(shi)政基礎設施工(gong)程領域(yu)疫(yi)情(qing)防控,有(you)序推(tui)動企(qi)業開復工(gong),現就有(you)關事項通知如(ru)下:

一、牢固樹立大局意識,有序推動企業開復工

(一)分區分級推動企業和項目開復工。地(di)(di)方各級住房和城鄉建設(she)主管部門要(yao)增強“四個(ge)意(yi)識”、堅定(ding)“四個(ge)自信”、做(zuo)到“兩個(ge)維護”,切(qie)實(shi)提高政治(zhi)站位,在地(di)(di)方黨委和政府統一領導(dao)下(xia),根據本(ben)地(di)(di)疫情防控要(yao)求(qiu),開(kai)展企業經營和工(gong)(gong)程(cheng)(cheng)項(xiang)(xiang)目建設(she)整體(ti)情況摸排,加強分類指(zhi)導(dao),以縣(市、區(qu)、旗)為單位,有(you)(you)序(xu)推動企業和項(xiang)(xiang)目開(kai)復(fu)工(gong)(gong)。低(di)風(feng)險(xian)地(di)(di)區(qu)要(yao)全(quan)面推動企業和工(gong)(gong)程(cheng)(cheng)項(xiang)(xiang)目開(kai)復(fu)工(gong)(gong),中風(feng)險(xian)地(di)(di)區(qu)要(yao)有(you)(you)序(xu)推動企業和工(gong)(gong)程(cheng)(cheng)項(xiang)(xiang)目分階段(duan)、錯(cuo)時開(kai)復(fu)工(gong)(gong),高風(feng)險(xian)地(di)(di)區(qu)要(yao)確保(bao)(bao)在疫情得到有(you)(you)效(xiao)防控后再(zai)逐步有(you)(you)序(xu)擴(kuo)大企業開(kai)復(fu)工(gong)(gong)范(fan)圍。涉及(ji)(ji)疫情防控、民生保(bao)(bao)障及(ji)(ji)其他重要(yao)國計民生的工(gong)(gong)程(cheng)(cheng)項(xiang)(xiang)目應優先開(kai)復(fu)工(gong)(gong),加快推動重大工(gong)(gong)程(cheng)(cheng)項(xiang)(xiang)目開(kai)工(gong)(gong)和建設(she),禁止搞“一刀切(qie)”。

(二)切實落實防疫管控要求地方各級住房和城鄉建設(she)主管(guan)部門要積極與(yu)地方衛(wei)(wei)生健康主管(guan)部門、疾控(kong)部門加強(qiang)統(tong)籌協(xie)調,根據實(shi)際情況制(zhi)定出(chu)臺(tai)建設(she)工(gong)程項(xiang)目疫情防(fang)控(kong)和開復(fu)工(gong)指南(nan),重點對企(qi)業(ye)(ye)組織(zhi)管(guan)理、人員集(ji)聚管(guan)理、人員排查、封閉管(guan)理、現(xian)場防(fang)疫物(wu)資儲備(bei)、衛(wei)(wei)生安全(quan)管(guan)理、應急措施等方面提出(chu)明確(que)要求,細化疫情防(fang)控(kong)措施,協(xie)助企(qi)業(ye)(ye)解(jie)決(jue)防(fang)控(kong)物(wu)資短缺等問題。強(qiang)化企(qi)業(ye)(ye)主體(ti)責(ze)任(ren),明確(que)已開復(fu)工(gong)項(xiang)目施工(gong)現(xian)場各方主體(ti)職責(ze),嚴(yan)格落實(shi)各項(xiang)防(fang)疫措施,切實(shi)保障企(qi)業(ye)(ye)開復(fu)工(gong)后不發生重大(da)疫情事項(xiang),全(quan)力服務(wu)國家疫情防(fang)控(kong)大(da)局。

(三)加強施工現場質量安全管理。地方各(ge)級住(zhu)房和城鄉建設主(zhu)管(guan)(guan)部門(men)要(yao)加(jia)(jia)強(qiang)(qiang)開(kai)(kai)(kai)復(fu)工(gong)(gong)(gong)(gong)(gong)期間(jian)工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)(cheng)質(zhi)(zhi)(zhi)量(liang)安(an)(an)全(quan)(quan)監管(guan)(guan)工(gong)(gong)(gong)(gong)(gong)作,加(jia)(jia)強(qiang)(qiang)風險研判,制定應對措施,創新監管(guan)(guan)模式(shi),嚴防發生(sheng)(sheng)(sheng)質(zhi)(zhi)(zhi)量(liang)安(an)(an)全(quan)(quan)事(shi)故。對近期擬開(kai)(kai)(kai)復(fu)工(gong)(gong)(gong)(gong)(gong)項(xiang)(xiang)目(mu),簡化工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)(cheng)質(zhi)(zhi)(zhi)量(liang)安(an)(an)全(quan)(quan)相(xiang)關程(cheng)(cheng)(cheng)(cheng)序要(yao)求(qiu),優化工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)(cheng)質(zhi)(zhi)(zhi)量(liang)安(an)(an)全(quan)(quan)相(xiang)關手續辦理流程(cheng)(cheng)(cheng)(cheng),鼓勵實行(xing)告知承(cheng)諾制,加(jia)(jia)強(qiang)(qiang)事(shi)后監管(guan)(guan),可以允許疫情(qing)解(jie)除后再補辦有關手續。對工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)(cheng)項(xiang)(xiang)目(mu)因疫情(qing)不(bu)能返崗的(de)管(guan)(guan)理人員,允許企業安(an)(an)排執(zhi)有相(xiang)應資格證書(shu)的(de)其(qi)他人員暫時頂崗,加(jia)(jia)快工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)(cheng)項(xiang)(xiang)目(mu)開(kai)(kai)(kai)復(fu)工(gong)(gong)(gong)(gong)(gong)。督(du)促企業落實安(an)(an)全(quan)(quan)生(sheng)(sheng)(sheng)產主(zhu)體(ti)責任,加(jia)(jia)強(qiang)(qiang)工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)(cheng)項(xiang)(xiang)目(mu)開(kai)(kai)(kai)復(fu)工(gong)(gong)(gong)(gong)(gong)前(qian)安(an)(an)全(quan)(quan)生(sheng)(sheng)(sheng)產條(tiao)件檢查,重(zhong)點排查深基坑(keng)、起重(zhong)機械、高支模以及城市軌道(dao)交(jiao)通工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)(cheng)等(deng)危(wei)險性較大的(de)分(fen)部分(fen)項(xiang)(xiang)工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)(cheng)安(an)(an)全(quan)(quan)隱(yin)患(huan),強(qiang)(qiang)化進場(chang)人員開(kai)(kai)(kai)復(fu)工(gong)(gong)(gong)(gong)(gong)前(qian)質(zhi)(zhi)(zhi)量(liang)安(an)(an)全(quan)(quan)、衛生(sheng)(sheng)(sheng)防疫等(deng)交(jiao)底(di),對準備工(gong)(gong)(gong)(gong)(gong)作不(bu)充分(fen)、防范(fan)措施不(bu)落實、隱(yin)患(huan)治理不(bu)到(dao)位的(de)工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)(cheng)項(xiang)(xiang)目(mu),嚴禁擅(shan)自開(kai)(kai)(kai)復(fu)工(gong)(gong)(gong)(gong)(gong)。督(du)促工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)(cheng)建設單(dan)位切實保障工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)(cheng)項(xiang)(xiang)目(mu)合理工(gong)(gong)(gong)(gong)(gong)期,嚴禁盲目(mu)搶(qiang)工(gong)(gong)(gong)(gong)(gong)期、趕進度等(deng)行(xing)為。

二、加大扶持力度,解決企業實際困難

(四)嚴格落實穩增長政策。地方(fang)各(ge)級(ji)住房和(he)(he)城(cheng)鄉(xiang)建設主(zhu)管部門要會同(tong)有關(guan)(guan)部門建立企(qi)(qi)業應對(dui)疫情專項幫扶機制,認真貫徹落(luo)實國家有關(guan)(guan)財稅(shui)、金(jin)(jin)融(rong)、社(she)保(bao)等支持政(zheng)策,指導企(qi)(qi)業用(yong)(yong)足用(yong)(yong)好(hao)延(yan)期繳納或(huo)減(jian)免稅(shui)款(kuan)、階段性緩繳或(huo)適當返還社(she)會保(bao)險費(fei)、減(jian)免房屋租金(jin)(jin)、加(jia)大職(zhi)工(gong)技能(neng)培訓補貼 等優惠政(zheng)策。加(jia)快推動銀(yin)企(qi)(qi)合(he)作,鼓勵商業銀(yin)行(xing)(xing)對(dui)信用(yong)(yong)評(ping)定優良的企(qi)(qi)業,在授信額度(du)、質押融(rong)資(zi)、貸款(kuan)利率等方(fang)面給(gei)予支持,有效降低(di)企(qi)(qi)業融(rong)資(zi)成本。大力推行(xing)(xing)工(gong)程(cheng)擔(dan)保(bao),以(yi)銀(yin)行(xing)(xing)保(bao)函、工(gong)程(cheng)擔(dan)保(bao)公司保(bao)函或(huo)工(gong)程(cheng)保(bao)證(zheng)保(bao)險替代(dai)保(bao)證(zheng)金(jin)(jin),減(jian)少企(qi)(qi)業資(zi)金(jin)(jin)占用(yong)(yong)。嚴格落(luo)實涉企(qi)(qi)收費(fei)清單制度(du),堅決制止各(ge)類亂(luan)收費(fei)、亂(luan)罰款(kuan)和(he)(he)亂(luan)攤派等行(xing)(xing)為(wei),切實降低(di)企(qi)(qi)業成本費(fei)用(yong)(yong)。

(五)加強合同履約變更管理。疫情(qing)防控(kong)導(dao)(dao)致工(gong)(gong)期(qi)延(yan)誤(wu),屬于合(he)(he)(he)同(tong)約(yue)定的(de)不可抗力情(qing)形。地(di)方(fang)各級(ji)住房和城鄉(xiang)建(jian)設主(zhu)管部門要引(yin)導(dao)(dao)企業加(jia)(jia)強合(he)(he)(he)同(tong)工(gong)(gong)期(qi)管理(li),根據(ju)實際(ji)情(qing)況依法與建(jian)設單(dan)位(wei)協商(shang)(shang)合(he)(he)(he)理(li)順延(yan)合(he)(he)(he)同(tong)工(gong)(gong)期(qi)。停工(gong)(gong)期(qi)間增加(jia)(jia)的(de)費(fei)(fei)用(yong)(yong),由發承(cheng)包(bao)(bao)雙方(fang)按(an)照(zhao)有關(guan)規定協商(shang)(shang)分擔。因(yin)疫情(qing)防控(kong)增 加(jia)(jia)的(de)防疫費(fei)(fei)用(yong)(yong),可計入工(gong)(gong)程造價(jia);因(yin)疫情(qing)造成的(de)人工(gong)(gong)、建(jian)材(cai)價(jia)格(ge)上(shang)漲等成本,發承(cheng)包(bao)(bao)雙方(fang)要加(jia)(jia)強協商(shang)(shang)溝通,按(an)照(zhao)合(he)(he)(he)同(tong)約(yue)定的(de)調(diao)價(jia)方(fang)法調(diao)整合(he)(he)(he)同(tong)價(jia)款。地(di)方(fang)各級(ji)住房和城鄉(xiang)建(jian) 設主(zhu)管部門要及時做好跟蹤測(ce)算(suan)和指導(dao)(dao)工(gong)(gong)作。

(六)加大用工用料保障力度。加強(qiang)部門協調聯動(dong),積極幫助(zhu)企(qi)(qi)業(ye)(ye)做好工(gong)(gong)(gong)人返(fan)(fan)崗(gang)、建筑材料(liao)及設備運(yun)輸、防疫物資保障(zhang)等(deng)工(gong)(gong)(gong)作(zuo)(zuo)。統(tong)籌推進(jin)建筑業(ye)(ye)產業(ye)(ye)鏈上下游協同復(fu)工(gong)(gong)(gong),加強(qiang)上下游配(pei)套企(qi)(qi)業(ye)(ye)溝通,協助(zhu)企(qi)(qi)業(ye)(ye)解(jie)決集中復(fu)工(gong)(gong)(gong)可(ke)能帶(dai)來的短期內(nei)原材料(liao)短缺或價格大幅上漲等(deng)問題(ti)。強(qiang)化企(qi)(qi)業(ye)(ye)用工(gong)(gong)(gong)保障(zhang),做好農(nong)民(min)工(gong)(gong)(gong)返(fan)(fan)崗(gang)復(fu)工(gong)(gong)(gong)點對(dui)點服務(wu)保障(zhang)工(gong)(gong)(gong)作(zuo)(zuo),指(zhi)導農(nong)民(min)工(gong)(gong)(gong)主要輸出(chu)地(di)和輸入(ru)地(di)做好人員返(fan)(fan)崗(gang)的對(dui)接和服務(wu),鼓勵(li)采用點對(dui)點包(bao)車等(deng)直達運(yun)輸方式(shi),減少分散(san)出(chu)行(xing)風險(xian)。開(kai)展(zhan)建筑工(gong)(gong)(gong)地(di)用工(gong)(gong)(gong)需求(qiu)(qiu)摸(mo)查(cha),及時發布用工(gong)(gong)(gong)需求(qiu)(qiu)信息,鼓勵(li)企(qi)(qi)業(ye)(ye)優先招用本(ben)地(di)農(nong)民(min)工(gong)(gong)(gong),引導企(qi)(qi)業(ye)(ye)采取短期有償借工(gong)(gong)(gong)等(deng)方式(shi),相(xiang)互調劑用工(gong)(gong)(gong)余缺。支持企(qi)(qi)業(ye)(ye)開(kai)展(zhan)農(nong)民(min)工(gong)(gong)(gong)在崗(gang)培(pei)訓,鼓勵(li)有條件的地(di)區(qu)設立復(fu)工(gong)(gong)(gong)補(bu)助(zhu)資金(jin),對(dui)農(nong)民(min)工(gong)(gong)(gong)包(bao)車、生(sheng)活、培(pei)訓等(deng)提供補(bu)貼,解(jie)決農(nong)民(min)工(gong)(gong)(gong)返(fan)(fan)崗(gang)的后顧之憂。

(七)切實減輕企業資金負擔。加快(kuai)清理(li)政(zheng)府部(bu)門(men)和(he)國(guo)有企(qi)業拖欠(qian)(qian)民(min)營企(qi)業賬款,建(jian)(jian)立和(he)完善防范(fan)拖欠(qian)(qian)長效機制,嚴(yan)(yan)禁(jin)政(zheng)府和(he)國(guo)有投(tou)資(zi)工(gong)(gong)(gong)程(cheng)以(yi)各種(zhong)方式要求企(qi)業帶資(zi)承包,建(jian)(jian)設(she)單(dan)位(wei)要按照合同(tong)約(yue)(yue)定按時(shi)(shi)足額支(zhi)付工(gong)(gong)(gong)程(cheng)款,避免形(xing)成(cheng)新的(de)拖欠(qian)(qian)。規(gui)范(fan)工(gong)(gong)(gong)程(cheng)價款結算(suan),政(zheng)府和(he)國(guo)有投(tou)資(zi)工(gong)(gong)(gong)程(cheng)不(bu)(bu)得以(yi)審計(ji)機關(guan)的(de)審計(ji)結論作為工(gong)(gong)(gong)程(cheng)結算(suan)依(yi)據,建(jian)(jian)設(she)單(dan)位(wei)不(bu)(bu)得以(yi)未完成(cheng)決(jue)算(suan)審計(ji)為由,拒(ju)絕或拖延(yan)辦(ban)理(li)工(gong)(gong)(gong)程(cheng)結算(suan)和(he)工(gong)(gong)(gong)程(cheng)款支(zhi)付。嚴(yan)(yan)格執行工(gong)(gong)(gong)程(cheng)建(jian)(jian)設(she)領域保(bao)證金(jin)(jin)(jin)相關(guan)規(gui)定,保(bao)證金(jin)(jin)(jin)到期(qi)應當及時(shi)(shi)予以(yi)返還(huan),未按規(gui)定或合同(tong)約(yue)(yue)定返還(huan)保(bao)證金(jin)(jin)(jin)的(de),保(bao)證金(jin)(jin)(jin)收取方應向企(qi)業支(zhi)付逾(yu)期(qi)返還(huan)違約(yue)(yue)金(jin)(jin)(jin)。優化農(nong)民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)保(bao)證金(jin)(jin)(jin)管理(li),疫情防控期(qi)間新開工(gong)(gong)(gong)的(de)工(gong)(gong)(gong)程(cheng)項目,可暫不(bu)(bu)收取農(nong)民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)保(bao)證金(jin)(jin)(jin)。

三、加快推進產業轉型,提升行業治理能力

(八)全面落實建筑工人實名制管理。所(suo)(suo)有(you)(you)開復(fu)工(gong)(gong)項(xiang)目(mu)原(yuan)則上實(shi)行封閉管理,嚴(yan)格按照有(you)(you)關規定落(luo)實(shi)建(jian)筑(zhu)工(gong)(gong)人實(shi)名(ming)制,實(shi)時(shi)記錄施工(gong)(gong)現場(chang)所(suo)(suo)有(you)(you)人員進出場(chang)信(xin)息,實(shi)行體(ti)溫檢測制度(du)(du),嚴(yan)禁(jin)無(wu)關人員進入(ru)施工(gong)(gong)現場(chang),最大限度(du)(du)減(jian)少施工(gong)(gong)現場(chang)人員流動(dong)。對(dui)不能(neng)實(shi)行封閉管理的(de)工(gong)(gong)程項(xiang)目(mu),要明 確施工(gong)(gong)區(qu)域(yu)(yu),做(zuo)好建(jian)筑(zhu)工(gong)(gong)人實(shi)名(ming)制管理,管控人員流動(dong)。有(you)(you)條件的(de)工(gong)(gong)程項(xiang)目(mu)要做(zuo)到作(zuo)(zuo)業(ye)區(qu)、辦(ban)公區(qu)和生活區(qu)的(de)相對(dui)隔離(li),并對(dui)施工(gong)(gong)現場(chang)劃分作(zuo)(zuo)業(ye)區(qu)域(yu)(yu),根(gen)據作(zuo)(zuo)業(ye)特點定時(shi)記錄區(qu)域(yu)(yu)內人員信(xin)息。

(九)大力推進企業數字化轉型。企業要加強(qiang)信息化建(jian)(jian)設,更多(duo)通過線上方式布(bu)置工作、實施質量安全管理、召開(kai)會議、匯報情況、招聘隊伍、采(cai)購建(jian)(jian)材和機械物資等,推進(jin)大數(shu)據、物聯網、建(jian)(jian)筑信息模型(BIM)、無人機等技術應用,提(ti)高工作效率,減少人員聚集和無序流動(dong)。

(十)積極推動電子政務建設全面(mian)推(tui)行電(dian)子招投標和異地遠程(cheng)評(ping)標,對(dui)非必(bi)(bi)須到現場辦(ban)理(li)(li)的業務,一律采用線上辦(ban)理(li)(li)。對(dui)涉及防疫防控或保(bao)障城市運行必(bi)(bi)需等特殊情況的應急工程(cheng)項目,經有關部門同意可(ke)以不(bu)進(jin)行招標。大(da)力推(tui)行施工許可(ke)線上全流程(cheng)辦(ban)理(li)(li)和電(dian)子證照,進(jin)一步簡化審批流程(cheng)。有條件的地區可(ke)采用“在線申(shen)報(bao)、在線審批、自行打證”模式,不(bu)再(zai)經政府辦(ban)事窗口現場辦(ban)理(li)(li)。

(十一)推動資質審批告知承諾制改革。實行資(zi)質申(shen)報、審(shen)批(pi)、公(gong)示、公(gong)告等業務的“一網通辦”,鼓勵采用(yong)郵寄等方(fang)式領取證書。各地可(ke)進一步擴大審(shen)批(pi)告知承諾制適用(yong)范(fan)圍,減少資(zi)質申(shen)報材料(liao),提高(gao)審(shen)批(pi)效率。

四、加強組織領導(dao),落(luo)實(shi)監管責任

(十二)建立完善工作機制。地方各級住房和(he)城鄉(xiang)建設主(zhu)管部門(men)要(yao)認真(zhen)履職(zhi)盡(jin)(jin)責(ze),在(zai)做好各項(xiang)疫情防(fang)控工作的同(tong)時,統籌開(kai)展房屋建筑和(he)市政基礎設施(shi)工程領域(yu)企(qi)(qi)業和(he)工程項(xiang)目開(kai)復工工作。結(jie)合地方實際(ji),進行專(zhuan)題研究部署,加強與(yu)相(xiang)關(guan)部門(men)協作聯動,切(qie)實采取有效措施(shi),協調解(jie)決企(qi)(qi)業開(kai)復工遇到的實際(ji)困難和(he)問題,最(zui)大程度(du)減少企(qi)(qi)業負擔和(he)損失,幫助企(qi)(qi)業盡(jin)(jin)快恢復正(zheng)常(chang)生產經營。

(十三)加大指導監督力度。地方各級住房和(he)城鄉建(jian)(jian)設主管(guan)部門(men)要加(jia)強對疫(yi)情防控期間企(qi)業(ye)(ye)經營的(de)監(jian)測(ce)分(fen)(fen)析和(he)指導監(jian)督,落(luo)實(shi)監(jian)管(guan)職(zhi)責,明確責任分(fen)(fen)工,加(jia)強對新建(jian)(jian)、改建(jian)(jian)、擴(kuo)建(jian)(jian)項目開復工的(de)監(jian)管(guan),強化疫(yi)情防控措施落(luo)實(shi),及(ji)時上報實(shi)施過程中存在的(de)問題及(ji)相關建(jian)(jian)議。充分(fen)(fen)發揮行(xing)業(ye)(ye)協會作用,及(ji)時了解市場(chang)運行(xing)情況和(he)企(qi)業(ye)(ye)訴求。加(jia)強輿(yu)論宣傳引導,打(da)(da)造各方協力、眾志成城的(de)良好氛(fen)圍,堅決打(da)(da)贏疫(yi)情防控的(de)人民戰爭、總體戰、阻擊戰。
