福建省政(zheng)府投資的(de)房屋建筑和市(shi)政(zheng)基(ji)礎設施工程(cheng)開展工程(cheng)總承包試點(dian)工作方案(an)


為貫(guan)徹落實(shi)《中共福(fu)建(jian)(jian)省(sheng)委 福(fu)建(jian)(jian)省(sheng)人(ren)民政府關于(yu)進一步加強城市(shi)(shi)規劃建(jian)(jian)設(she)管(guan)理工(gong)(gong)(gong)(gong)作(zuo)的(de)(de)實(shi)施(shi)意(yi)見(jian)》(閩委發〔2016〕16號)和(he)《住房城鄉(xiang)建(jian)(jian)設(she)部關于(yu)進一步推進工(gong)(gong)(gong)(gong)程(cheng)總承(cheng)包(bao)發展的(de)(de)若干意(yi)見(jian)》(建(jian)(jian)市(shi)(shi)〔2016〕93號),深化建(jian)(jian)設(she)項目組織實(shi)施(shi)方式改革,推廣(guang)工(gong)(gong)(gong)(gong)程(cheng)總承(cheng)包(bao)制,提升工(gong)(gong)(gong)(gong)程(cheng)建(jian)(jian)設(she)質(zhi)量和(he)效益(yi),根(gen)據《住房城鄉(xiang)建(jian)(jian)設(she)部辦(ban)公廳關于(yu)同意(yi)上海等7省(sheng)市(shi)(shi)開展工(gong)(gong)(gong)(gong)程(cheng)總承(cheng)包(bao)試點工(gong)(gong)(gong)(gong)作(zuo)的(de)(de)函》(建(jian)(jian)辦(ban)市(shi)(shi)〔2016〕415號)的(de)(de)要求,現制定本試點工(gong)(gong)(gong)(gong)作(zuo)方案。

一、工作(zuo)目(mu)標

利用兩(liang)年的(de)(de)時(shi)間(jian)在我省政(zheng)府投(tou)資的(de)(de)房屋建(jian)(jian)(jian)筑(zhu)和市政(zheng)基(ji)(ji)礎設(she)施(shi)工程(cheng)組織開展(zhan)(zhan)工程(cheng)總承包(bao)試點(dian),深(shen)化建(jian)(jian)(jian)設(she)項(xiang)目組織實施(shi)方式改(gai)革,健(jian)全完善工程(cheng)總承包(bao)制(zhi)度,提高項(xiang)目建(jian)(jian)(jian)設(she)管理水平。推進項(xiang)目設(she)計(ji)與施(shi)工的(de)(de)深(shen)度融(rong)合,培育發展(zhan)(zhan)工程(cheng)總承包(bao)企(qi)業,打(da)造(zao)具有綜合競爭(zheng)力的(de)(de)建(jian)(jian)(jian)筑(zhu)業龍頭(tou)企(qi)業,為企(qi)業走出(chu)去參與國家“一(yi)帶一(yi)路”戰(zhan)略奠定基(ji)(ji)礎。進一(yi)步(bu)規范建(jian)(jian)(jian)筑(zhu)市場(chang)秩序,強化落(luo)實各方主(zhu)體責任,有效遏制(zhi)建(jian)(jian)(jian)筑(zhu)市場(chang)違法行(xing)為,營造(zao)良好的(de)(de)建(jian)(jian)(jian)筑(zhu)業發展(zhan)(zhan)環境。

二、實施部門

工(gong)程總承包試點工(gong)作(zuo)由省住(zhu)建廳負責,具體工(gong)作(zuo)由各設區市建設主管(guan)部門(含平(ping)潭綜合實(shi)驗(yan)區交建局,下同)組織實(shi)施,發(fa)改(gai)、財政部門應當按照(zhao)職(zhi)責分(fen)工(gong)做(zuo)好相關工(gong)作(zuo)。

三(san)、工(gong)作(zuo)步驟

工(gong)程總(zong)承包試點工(gong)作分三個階(jie)段實(shi)施:

(一)準備(bei)階段(2016年(nian)12月(yue)~2017年(nian)1月(yue))

1.確定試(shi)點企業

(1)列為福(fu)建省建筑業(ye)龍頭(tou)企業(ye)的設計單位、建筑工(gong)(gong)程(cheng)資質施工(gong)(gong)總承包企業(ye)、市政(zheng)公用工(gong)(gong)程(cheng)資質施工(gong)(gong)總承包企業(ye);

(2)由(you)各設(she)(she)區市建(jian)設(she)(she)主管部門另行推(tui)薦2-3家具備工(gong)(gong)程總承(cheng)(cheng)包(bao)(bao)能(neng)力的設(she)(she)計(ji)單位(wei)或(huo)建(jian)筑業(ye)(ye)企(qi)業(ye)(ye)。設(she)(she)計(ji)單位(wei)應當具有相應專(zhuan)業(ye)(ye)甲(jia)級(ji)及以(yi)上(shang)設(she)(she)計(ji)資(zi)(zi)(zi)(zi)質(zhi),建(jian)筑業(ye)(ye)企(qi)業(ye)(ye)應當具有一級(ji)及以(yi)上(shang)建(jian)筑工(gong)(gong)程資(zi)(zi)(zi)(zi)質(zhi)或(huo)市政公用(yong)工(gong)(gong)程資(zi)(zi)(zi)(zi)質(zhi)。優先推(tui)薦同(tong)時具有上(shang)述(shu)設(she)(she)計(ji)資(zi)(zi)(zi)(zi)質(zhi)和施工(gong)(gong)總承(cheng)(cheng)包(bao)(bao)資(zi)(zi)(zi)(zi)質(zhi)的企(qi)業(ye)(ye)。

各設區市建(jian)設主管部門應當(dang)于2017年(nian)1月15日前將另行推薦的試點(dian)企業(ye)名(ming)單上報省(sheng)(sheng)住建(jian)廳。全省(sheng)(sheng)房屋建(jian)筑和市政基(ji)礎(chu)設施工程的工程總(zong)承包試點(dian)企業(ye)名(ming)單由省(sheng)(sheng)住建(jian)廳、省(sheng)(sheng)發改委匯總(zong)公布。

2.確(que)定試(shi)點項目

各設區(qu)(qu)市(shi)建設主管部門(men)應會(hui)商發(fa)改(gai)、財政等部門(men)組織選定一批政府投資的工程(cheng)項(xiang)(xiang)目作為工程(cheng)總承包(bao)試(shi)點(dian)項(xiang)(xiang)目并(bing)向社(she)會(hui)主動公開(福州、廈(sha)門(men)、泉(quan)州市(shi)各安排不(bu)少(shao)于5個工程(cheng)項(xiang)(xiang)目,平潭綜合實驗(yan)區(qu)(qu)不(bu)少(shao)于2個,其他(ta)設區(qu)(qu)市(shi)不(bu)少(shao)于3個)。試(shi)點(dian)項(xiang)(xiang)目原(yuan)則上為采用通用技術的房屋建筑和市(shi)政基礎設施工程(cheng),優先安排裝配式(shi)建筑開展試(shi)點(dian)。

上述(shu)所稱(cheng)的(de)房屋建(jian)筑(zhu)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)是指各類結構形(xing)式的(de)民用(yong)建(jian)筑(zhu)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)、工(gong)(gong)(gong)(gong)(gong)(gong)(gong)業建(jian)筑(zhu)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)、構筑(zhu)物(wu)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)以(yi)及相(xiang)配套(tao)的(de)道(dao)路、電信、管(guan)網(wang)管(guan)線等(deng)設(she)施(shi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)。發包(bao)的(de)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)內(nei)容應當(dang)包(bao)括(kuo)(kuo)地基(ji)與基(ji)礎(chu)(chu)、主體結構、建(jian)筑(zhu)屋面、裝修裝飾、建(jian)筑(zhu)幕(mu)墻、附建(jian)人(ren)防工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)以(yi)及給水排(pai)水及供(gong)暖、通風與空調、電氣(qi)、消防、智能(neng)、防雷等(deng)配套(tao)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)。市(shi)政基(ji)礎(chu)(chu)設(she)施(shi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)包(bao)括(kuo)(kuo)給水工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)、排(pai)水工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)、燃氣(qi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)、熱力(li)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)、城(cheng)(cheng)市(shi)道(dao)路工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)、城(cheng)(cheng)市(shi)橋梁工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)、城(cheng)(cheng)市(shi)隧道(dao)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)、公共交通工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)、軌道(dao)交通工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)、環境衛生工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)、照明工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)、綠化工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)(cheng)。

(二)實施階段(2017年2月~2018年9月)

各設區市(shi)建設主管部門應當會同發改、財政(zheng)、審(shen)計(ji)部門對試點項(xiang)目的(de)(de)(de)實(shi)施情況進(jin)行跟(gen)蹤,及時研(yan)究解決(jue)試點項(xiang)目推進(jin)過程出現的(de)(de)(de)問題;對試點項(xiang)目的(de)(de)(de)招標投標、施工(gong)(gong)圖(tu)審(shen)查、合(he)同備(bei)案、質量安全監督、施工(gong)(gong)許可、工(gong)(gong)程竣工(gong)(gong)驗(yan)收備(bei)案、城(cheng)建檔(dang)案移交等環節和(he)工(gong)(gong)程質量、安全、造(zao)價、進(jin)度等方面中(zhong)出現的(de)(de)(de)問題給(gei)予技術指導與服務。

(三)總結階段(2018年10月~2018年12月)

省住建(jian)(jian)廳會同(tong)省發改委、省財政廳、省審計廳組織各(ge)設區市對試(shi)點(dian)情(qing)況進行階段性總結(jie),梳理試(shi)點(dian)項(xiang)目在實(shi)施(shi)過程中存在的問題,研究完善具體政策措施(shi)和工作標準,構建(jian)(jian)工程總承包(bao)模式下建(jian)(jian)設各(ge)方主體的質量安(an)全(quan)責任(ren)體系,并在全(quan)省全(quan)面推廣實(shi)施(shi)工程總承包(bao)模式。

四、試點措施

(一(yi))工程(cheng)發包

1.建(jian)設(she)(she)單(dan)位(wei)可以根(gen)據項(xiang)目特點,自行決定(ding)(ding)(ding)在(zai)可研(yan)(yan)批復(fu)(fu)或(huo)(huo)者(zhe)初步設(she)(she)計(ji)(ji)審(shen)(shen)批后(hou)采用工(gong)(gong)程(cheng)總(zong)承(cheng)包(bao)(bao)(bao)模式(shi)發(fa)包(bao)(bao)(bao),按照(zhao)《福建(jian)省工(gong)(gong)程(cheng)建(jian)設(she)(she)項(xiang)目招標事(shi)項(xiang)核(he)準實施(shi)辦(ban)法(fa)》(閩發(fa)改法(fa)規(gui)〔2015〕404號(hao))的(de)(de)規(gui)定(ding)(ding)(ding)確定(ding)(ding)(ding)發(fa)包(bao)(bao)(bao)方式(shi)。對(dui)于政(zheng)(zheng)府投資的(de)(de)工(gong)(gong)程(cheng)項(xiang)目,在(zai)可研(yan)(yan)批復(fu)(fu)后(hou)進(jin)行工(gong)(gong)程(cheng)總(zong)承(cheng)包(bao)(bao)(bao)發(fa)包(bao)(bao)(bao)的(de)(de),宜(yi)采用預算后(hou)審(shen)(shen)方式(shi)并在(zai)招標文(wen)件或(huo)(huo)者(zhe)發(fa)包(bao)(bao)(bao)合(he)同(tong)中約(yue)定(ding)(ding)(ding)。在(zai)初步設(she)(she)計(ji)(ji)審(shen)(shen)批后(hou)進(jin)行工(gong)(gong)程(cheng)總(zong)承(cheng)包(bao)(bao)(bao)發(fa)包(bao)(bao)(bao)的(de)(de),宜(yi)采用固定(ding)(ding)(ding)總(zong)價(jia)(jia)合(he)同(tong)方式(shi)。在(zai)財政(zheng)(zheng)審(shen)(shen)核(he)和審(shen)(shen)計(ji)(ji)時,僅對(dui)建(jian)設(she)(she)單(dan)位(wei)依法(fa)依規(gui)新(xin)增變更部(bu)分進(jin)行審(shen)(shen)核(he),對(dui)固定(ding)(ding)(ding)總(zong)價(jia)(jia)包(bao)(bao)(bao)干(gan)部(bu)分僅審(shen)(shen)核(he)、審(shen)(shen)計(ji)(ji)其建(jian)設(she)(she)的(de)(de)規(gui)模、標準及所用的(de)(de)主要(yao)材料、設(she)(she)備等是否(fou)符(fu)合(he)原設(she)(she)計(ji)(ji)方案(an)和總(zong)承(cheng)包(bao)(bao)(bao)合(he)同(tong)條(tiao)款要(yao)求。結算價(jia)(jia)款調(diao)整應符(fu)合(he)合(he)同(tong)條(tiao)款的(de)(de)約(yue)定(ding)(ding)(ding)。

采用固定總(zong)價(jia)(jia)(jia)合同(tong)(tong)方式的(de)項目,招(zhao)標(biao)(biao)文(wen)件應當約定總(zong)價(jia)(jia)(jia)包干范圍以(yi)及合同(tong)(tong)價(jia)(jia)(jia)格調整的(de)變更范圍、價(jia)(jia)(jia)格調整辦(ban)法(fa)等事(shi)項。中(zhong)標(biao)(biao)人(ren)在完成施(shi)工(gong)(gong)圖設計并(bing)經審(shen)(shen)查后(hou),編(bian)制的(de)施(shi)工(gong)(gong)圖預算(suan)(原則(ze)上(shang)不(bu)(bu)得超過中(zhong)標(biao)(biao)價(jia)(jia)(jia))應當經建設單位及財(cai)政審(shen)(shen)核部(bu)門(如(ru)需)審(shen)(shen)核。經審(shen)(shen)核后(hou)的(de)預算(suan)造價(jia)(jia)(jia)作為按進(jin)度(du)支付及結算(suan)工(gong)(gong)程(cheng)(cheng)款(kuan)的(de)依據(ju),除(chu)招(zhao)標(biao)(biao)文(wen)件或工(gong)(gong)程(cheng)(cheng)總(zong)承包合同(tong)(tong)中(zhong)約定可(ke)以(yi)變更價(jia)(jia)(jia)款(kuan)外,其(qi)他(ta)不(bu)(bu)予(yu)調整。

采用預(yu)算(suan)(suan)(suan)后(hou)(hou)審(shen)(shen)方(fang)(fang)式的(de)(de)項目(mu),應(ying)當(dang)執行限額設(she)(she)計(ji)(ji)(ji)(ji),按(an)(an)照風(feng)險共(gong)擔原則,加強工程項目(mu)的(de)(de)總投(tou)(tou)資(zi)、設(she)(she)計(ji)(ji)(ji)(ji)內(nei)容標(biao)準(zhun)及各個階段造價的(de)(de)控制(zhi),并在招標(biao)文(wen)件中(zhong)(zhong)約(yue)定工程預(yu)算(suan)(suan)(suan)、結(jie)算(suan)(suan)(suan)編制(zhi)依(yi)據(ju)、綜(zong)合(he)(he)單(dan)價取(qu)值辦(ban)法(fa)和價格(ge)調整辦(ban)法(fa)等(deng)事(shi)項。投(tou)(tou)標(biao)人(ren)(ren)(ren)依(yi)據(ju)投(tou)(tou)標(biao)設(she)(she)計(ji)(ji)(ji)(ji)方(fang)(fang)案編制(zhi)投(tou)(tou)標(biao)報(bao)(bao)價。中(zhong)(zhong)標(biao)價僅作(zuo)為(wei)合(he)(he)同(tong)暫(zan)定價,其中(zhong)(zhong)勘(kan)察(cha)設(she)(she)計(ji)(ji)(ji)(ji)等(deng)咨(zi)詢費可以(yi)確定計(ji)(ji)(ji)(ji)費標(biao)準(zhun)和下浮系數。在中(zhong)(zhong)標(biao)人(ren)(ren)(ren)完成(cheng)初(chu)步設(she)(she)計(ji)(ji)(ji)(ji)和設(she)(she)計(ji)(ji)(ji)(ji)概算(suan)(suan)(suan)(政(zheng)府(fu)投(tou)(tou)資(zi)項目(mu)不得超出可研(yan)批準(zhun)的(de)(de)估(gu)算(suan)(suan)(suan)上浮允許范圍)報(bao)(bao)建設(she)(she)單(dan)位(wei)按(an)(an)程序履行報(bao)(bao)批手續后(hou)(hou),中(zhong)(zhong)標(biao)人(ren)(ren)(ren)進行施(shi)工圖設(she)(she)計(ji)(ji)(ji)(ji)并編制(zhi)預(yu)算(suan)(suan)(suan)。預(yu)算(suan)(suan)(suan)造價經建設(she)(she)單(dan)位(wei)及財(cai)政(zheng)審(shen)(shen)核(he)(he)部門(如需)審(shen)(shen)核(he)(he)確定后(hou)(hou)作(zuo)為(wei)合(he)(he)同(tong)價,并簽訂合(he)(he)同(tong)補充(chong)協議(yi)。經審(shen)(shen)核(he)(he)后(hou)(hou)的(de)(de)預(yu)算(suan)(suan)(suan)造價,作(zuo)為(wei)施(shi)工期間(jian)進度款的(de)(de)支付(fu)及結(jie)算(suan)(suan)(suan)依(yi)據(ju)。施(shi)工期間(jian)發(fa)生變更的(de)(de),應(ying)當(dang)按(an)(an)規(gui)定經建設(she)(she)單(dan)位(wei)及財(cai)政(zheng)審(shen)(shen)核(he)(he)部門或(huo)項目(mu)審(shen)(shen)批部門(如需)批準(zhun)后(hou)(hou)列入結(jie)算(suan)(suan)(suan),結(jie)算(suan)(suan)(suan)金額以(yi)有(you)資(zi)質的(de)(de)第三方(fang)(fang)或(huo)財(cai)政(zheng)審(shen)(shen)核(he)(he)部門(如需)審(shen)(shen)核(he)(he)結(jie)果為(wei)準(zhun)計(ji)(ji)(ji)(ji)取(qu)。

2.招(zhao)(zhao)(zhao)(zhao)標(biao)(biao)(biao)(biao)文件(jian)應(ying)當明(ming)確招(zhao)(zhao)(zhao)(zhao)標(biao)(biao)(biao)(biao)范圍和(he)招(zhao)(zhao)(zhao)(zhao)標(biao)(biao)(biao)(biao)控(kong)制價,細化(hua)建設(she)規模、建設(she)標(biao)(biao)(biao)(biao)準以及是否采取裝(zhuang)配式建造方式、BIM技術(shu)等(deng)招(zhao)(zhao)(zhao)(zhao)標(biao)(biao)(biao)(biao)需求(qiu)事項(xiang)。招(zhao)(zhao)(zhao)(zhao)標(biao)(biao)(biao)(biao)人(ren)應(ying)當合理(li)確定招(zhao)(zhao)(zhao)(zhao)標(biao)(biao)(biao)(biao)時(shi)間,確保投(tou)標(biao)(biao)(biao)(biao)人(ren)有足夠(gou)時(shi)間對招(zhao)(zhao)(zhao)(zhao)標(biao)(biao)(biao)(biao)文件(jian)進(jin)行(xing)仔細研究(jiu)、了解招(zhao)(zhao)(zhao)(zhao)標(biao)(biao)(biao)(biao)人(ren)的(de)招(zhao)(zhao)(zhao)(zhao)標(biao)(biao)(biao)(biao)需求(qiu)、進(jin)行(xing)必要的(de)深化(hua)設(she)計、風險評估和(he)估算。各級建設(she)主管部門應(ying)當做好試點項(xiang)目的(de)招(zhao)(zhao)(zhao)(zhao)標(biao)(biao)(biao)(biao)投(tou)標(biao)(biao)(biao)(biao)活動監管和(he)指導服務(wu)工(gong)作。省住建廳積極做好具有工(gong)程總承包(bao)招(zhao)(zhao)(zhao)(zhao)投(tou)標(biao)(biao)(biao)(biao)經驗的(de)招(zhao)(zhao)(zhao)(zhao)標(biao)(biao)(biao)(biao)代(dai)理(li)機構信息公布,為招(zhao)(zhao)(zhao)(zhao)標(biao)(biao)(biao)(biao)人(ren)選用提供參考。

3.招(zhao)(zhao)標(biao)公(gong)告(投(tou)標(biao)邀請書)和招(zhao)(zhao)標(biao)文件中,應(ying)當明確投(tou)標(biao)單(dan)位為我(wo)省房屋建筑(zhu)和市政基礎設(she)施工(gong)程(cheng)(cheng)的(de)工(gong)程(cheng)(cheng)總(zong)承(cheng)包試點(dian)企業(ye)。鼓(gu)勵(li)技術、管理(li)力量較強且(qie)具(ju)有設(she)計資質的(de)企業(ye)為工(gong)程(cheng)(cheng)總(zong)承(cheng)包企業(ye),承(cheng)擔(dan)工(gong)程(cheng)(cheng)項目前期咨詢工(gong)作的(de)試點(dian)企業(ye),可以參與本(ben)試點(dian)項目的(de)工(gong)程(cheng)(cheng)總(zong)承(cheng)包投(tou)標(biao)。

工(gong)(gong)程總(zong)承包項目(mu)(mu)(mu)項目(mu)(mu)(mu)負(fu)(fu)(fu)責人(ren)(ren)(也稱(cheng)“項目(mu)(mu)(mu)經(jing)理”)應(ying)為(wei)注冊(ce)建(jian)(jian)筑師(shi)、注冊(ce)結構工(gong)(gong)程師(shi)、注冊(ce)一(yi)級(ji)建(jian)(jian)造(zao)師(shi)或(huo)(huo)高(gao)級(ji)專業技術職稱(cheng),熟悉工(gong)(gong)程總(zong)承包項目(mu)(mu)(mu)管理知識、相(xiang)關法律(lv)法規和(he)標準(zhun),并具(ju)備較強的(de)組織協(xie)調能力和(he)良好的(de)職業道德。項目(mu)(mu)(mu)負(fu)(fu)(fu)責人(ren)(ren)還應(ying)當承擔過(guo)工(gong)(gong)程總(zong)承包項目(mu)(mu)(mu)負(fu)(fu)(fu)責人(ren)(ren),或(huo)(huo)承擔過(guo)大(da)中型工(gong)(gong)程項目(mu)(mu)(mu)的(de)設計項目(mu)(mu)(mu)負(fu)(fu)(fu)責人(ren)(ren)、代建(jian)(jian)項目(mu)(mu)(mu)負(fu)(fu)(fu)責人(ren)(ren)或(huo)(huo)者施工(gong)(gong)項目(mu)(mu)(mu)負(fu)(fu)(fu)責人(ren)(ren)。

4.工(gong)(gong)(gong)程總(zong)(zong)承包(bao)(bao)(bao)評(ping)(ping)標應(ying)采用(yong)(yong)綜合(he)(he)評(ping)(ping)估法(fa),評(ping)(ping)審的(de)主(zhu)要(yao)因素包(bao)(bao)(bao)括工(gong)(gong)(gong)程總(zong)(zong)承包(bao)(bao)(bao)報價、項(xiang)目(mu)管(guan)(guan)理組織方(fang)案(an)、設(she)計(ji)(ji)方(fang)案(an)、設(she)備(bei)采購(gou)方(fang)案(an)、施工(gong)(gong)(gong)計(ji)(ji)劃、工(gong)(gong)(gong)程業(ye)(ye)績(ji)(ji)等。在(zai)試點期(qi)間,不宜將工(gong)(gong)(gong)程業(ye)(ye)績(ji)(ji)限定為(wei)工(gong)(gong)(gong)程總(zong)(zong)承包(bao)(bao)(bao)業(ye)(ye)績(ji)(ji),可以(yi)(yi)設(she)置(zhi)為(wei)相應(ying)施工(gong)(gong)(gong)業(ye)(ye)績(ji)(ji)或設(she)計(ji)(ji)業(ye)(ye)績(ji)(ji)。在(zai)可研批(pi)復后進行工(gong)(gong)(gong)程總(zong)(zong)承包(bao)(bao)(bao)招(zhao)標的(de)項(xiang)目(mu),評(ping)(ping)分權(quan)重(zhong)側重(zhong)于投標設(she)計(ji)(ji)方(fang)案(an)的(de)分析及優(you)化(hua)方(fang)面;在(zai)初(chu)步設(she)計(ji)(ji)審批(pi)后進行工(gong)(gong)(gong)程總(zong)(zong)承包(bao)(bao)(bao)招(zhao)標的(de)項(xiang)目(mu),評(ping)(ping)分權(quan)重(zhong)兼(jian)顧設(she)計(ji)(ji)方(fang)案(an)優(you)化(hua)、投標報價、項(xiang)目(mu)管(guan)(guan)理組織方(fang)案(an)及施工(gong)(gong)(gong)計(ji)(ji)劃等方(fang)面。支持(chi)工(gong)(gong)(gong)程總(zong)(zong)承包(bao)(bao)(bao)項(xiang)目(mu)科(ke)(ke)技創新應(ying)用(yong)(yong),招(zhao)標文件可以(yi)(yi)設(she)置(zhi)對主(zhu)動(dong)采用(yong)(yong)裝配(pei)式(shi)建造方(fang)式(shi)、建筑信息模型(BIM)技術、消能(neng)減震技術、智(zhi)能(neng)化(hua)技術等科(ke)(ke)技應(ying)用(yong)(yong)加分事項(xiang),并在(zai)合(he)(he)同(tong)中予以(yi)(yi)約定。

裝配式建筑(zhu)項目(mu)的(de)評審要(yao)素,可以按照(zhao)《關于我省(sheng)建筑(zhu)產業現代(dai)化(hua)試點期(qi)間(jian)做好工業化(hua)建筑(zhu)工程(cheng)項目(mu)招標(biao)(biao)投標(biao)(biao)活動的(de)指導意見》(閩建筑(zhu)〔2015〕16號)的(de)規(gui)定執(zhi)行。

(二(er))主(zhu)體責任

1.工(gong)(gong)(gong)程(cheng)總承(cheng)(cheng)包(bao)(bao)企業(ye)(ye)可以在其(qi)(qi)資質許可范(fan)圍內自(zi)行實(shi)施(shi)工(gong)(gong)(gong)程(cheng)的(de)勘察、設(she)(she)計(ji)、采購和(he)施(shi)工(gong)(gong)(gong)。工(gong)(gong)(gong)程(cheng)總承(cheng)(cheng)包(bao)(bao)企業(ye)(ye)自(zi)行實(shi)施(shi)設(she)(she)計(ji)的(de),不得將(jiang)工(gong)(gong)(gong)程(cheng)總承(cheng)(cheng)包(bao)(bao)項目工(gong)(gong)(gong)程(cheng)主(zhu)體(ti)部(bu)分(fen)的(de)設(she)(she)計(ji)業(ye)(ye)務分(fen)包(bao)(bao)給其(qi)(qi)他單位。工(gong)(gong)(gong)程(cheng)總承(cheng)(cheng)包(bao)(bao)企業(ye)(ye)自(zi)行實(shi)施(shi)施(shi)工(gong)(gong)(gong)的(de),不得將(jiang)工(gong)(gong)(gong)程(cheng)總承(cheng)(cheng)包(bao)(bao)項目工(gong)(gong)(gong)程(cheng)主(zhu)體(ti)結(jie)構的(de)施(shi)工(gong)(gong)(gong)業(ye)(ye)務分(fen)包(bao)(bao)給其(qi)(qi)他單位。工(gong)(gong)(gong)程(cheng)總承(cheng)(cheng)包(bao)(bao)企業(ye)(ye)同時具有資質許可范(fan)圍內的(de)設(she)(she)計(ji)、施(shi)工(gong)(gong)(gong)能力(li)的(de),應當自(zi)行組織實(shi)施(shi)工(gong)(gong)(gong)程(cheng)主(zhu)體(ti)部(bu)分(fen)的(de)設(she)(she)計(ji)和(he)主(zhu)體(ti)結(jie)構的(de)施(shi)工(gong)(gong)(gong)。

2.分(fen)包(bao)(bao)(bao)工作(zuo)由工程(cheng)總(zong)(zong)承(cheng)(cheng)包(bao)(bao)(bao)企(qi)業負責(ze),工程(cheng)總(zong)(zong)承(cheng)(cheng)包(bao)(bao)(bao)企(qi)業可以根據(ju)合同約定或者經(jing)建設單位(wei)同意,將工程(cheng)項(xiang)(xiang)目(mu)(mu)的(de)設計或者施(shi)(shi)工業務分(fen)包(bao)(bao)(bao)給具有(you)相(xiang)應(ying)(ying)資(zi)質的(de)企(qi)業。僅具有(you)設計資(zi)質的(de)企(qi)業承(cheng)(cheng)接工程(cheng)總(zong)(zong)承(cheng)(cheng)包(bao)(bao)(bao)項(xiang)(xiang)目(mu)(mu)時(shi),應(ying)(ying)當將工程(cheng)總(zong)(zong)承(cheng)(cheng)包(bao)(bao)(bao)項(xiang)(xiang)目(mu)(mu)中的(de)施(shi)(shi)工業務分(fen)包(bao)(bao)(bao)給具有(you)相(xiang)應(ying)(ying)施(shi)(shi)工資(zi)質的(de)企(qi)業。僅具有(you)施(shi)(shi)工資(zi)質的(de)企(qi)業承(cheng)(cheng)接工程(cheng)總(zong)(zong)承(cheng)(cheng)包(bao)(bao)(bao)項(xiang)(xiang)目(mu)(mu)時(shi),應(ying)(ying)當將工程(cheng)總(zong)(zong)承(cheng)(cheng)包(bao)(bao)(bao)項(xiang)(xiang)目(mu)(mu)中的(de)設計業務分(fen)包(bao)(bao)(bao)給具有(you)相(xiang)應(ying)(ying)設計資(zi)質的(de)企(qi)業。

3.工(gong)程(cheng)(cheng)總承(cheng)(cheng)包(bao)(bao)企(qi)業(ye)按照工(gong)程(cheng)(cheng)總承(cheng)(cheng)包(bao)(bao)合同(tong)的(de)約定,對總承(cheng)(cheng)包(bao)(bao)工(gong)程(cheng)(cheng)范圍內的(de)工(gong)程(cheng)(cheng)設計、施(shi)工(gong)質(zhi)量、安(an)全生產、施(shi)工(gong)工(gong)期、工(gong)程(cheng)(cheng)造價等負(fu)(fu)總責。各勘察、設計、施(shi)工(gong)和(he)采購企(qi)業(ye)按照合同(tong)約定對其分(fen)包(bao)(bao)工(gong)程(cheng)(cheng)的(de)質(zhi)量安(an)全向總承(cheng)(cheng)包(bao)(bao)企(qi)業(ye)負(fu)(fu)責,工(gong)程(cheng)(cheng)總承(cheng)(cheng)包(bao)(bao)企(qi)業(ye)與分(fen)包(bao)(bao)企(qi)業(ye)對分(fen)包(bao)(bao)工(gong)程(cheng)(cheng)的(de)質(zhi)量安(an)全承(cheng)(cheng)擔連帶責任。

(三)項(xiang)目(mu)實施

1.工程總承包項(xiang)目(mu)(mu)應當(dang)配(pei)備相(xiang)應的(de)項(xiang)目(mu)(mu)管(guan)(guan)理班子,符合資格要求的(de)項(xiang)目(mu)(mu)負(fu)(fu)(fu)責人(ren)(ren)可(ke)兼任本項(xiang)目(mu)(mu)的(de)設(she)計負(fu)(fu)(fu)責人(ren)(ren)或施工負(fu)(fu)(fu)責人(ren)(ren)。建(jian)設(she)主(zhu)管(guan)(guan)部門(men)加強(qiang)工程總承包項(xiang)目(mu)(mu)監管(guan)(guan),實施項(xiang)目(mu)(mu)負(fu)(fu)(fu)責人(ren)(ren)、設(she)計負(fu)(fu)(fu)責人(ren)(ren)、施工負(fu)(fu)(fu)責人(ren)(ren)備案(an)管(guan)(guan)理。

2.工(gong)(gong)程(cheng)實(shi)施過程(cheng)中各類工(gong)(gong)程(cheng)管(guan)理(li)技(ji)術文件、報(bao)驗表格(ge)(ge)等應作(zuo)相(xiang)(xiang)應調整,增(zeng)加工(gong)(gong)程(cheng)總承包企業以及(ji)人員(yuan)欄目,由工(gong)(gong)程(cheng)總承包企業簽署(shu)(shu)意(yi)(yi)見(jian),各勘察、設計、施工(gong)(gong)企業根據(ju)其實(shi)際承擔的工(gong)(gong)程(cheng)內容在管(guan)理(li)技(ji)術文件、報(bao)驗表格(ge)(ge)的相(xiang)(xiang)應位置簽署(shu)(shu)意(yi)(yi)見(jian)。

3.工(gong)(gong)程竣工(gong)(gong)驗收由建(jian)設(she)單(dan)位組織,工(gong)(gong)程總承(cheng)包(bao)企業(ye)、勘察(cha)、設(she)計、施工(gong)(gong)、監理等(deng)建(jian)設(she)各方主體(ti)參加。工(gong)(gong)程保修責任書由工(gong)(gong)程總承(cheng)包(bao)企業(ye)簽署,并(bing)(bing)由其負責向建(jian)設(she)單(dan)位移交(jiao)全套(tao)工(gong)(gong)程技(ji)術資料(liao)。項目前期(qi)資料(liao)由建(jian)設(she)單(dan)位負責收集,并(bing)(bing)由建(jian)設(she)單(dan)位向城建(jian)檔案(an)管理部門移交(jiao)建(jian)設(she)工(gong)(gong)程檔案(an)。

4.建(jian)設單位應當確(que)保建(jian)設資金及時到位,宜采用(yong)按比例(li)或按月(yue)度(du)約(yue)定額度(du)支付方(fang)式并(bing)在合(he)同中予以明(ming)確(que)。

(四)監(jian)督管理

1.按(an)(an)照法規(gui)規(gui)定進(jin)行施(shi)(shi)工(gong)(gong)圖設計(ji)審(shen)查的工(gong)(gong)程(cheng)總承包(bao)(bao)(bao)項目,施(shi)(shi)工(gong)(gong)圖審(shen)查機(ji)構可以(yi)根(gen)據實際情況(kuang)按(an)(an)照樁基與主體(ti)結構兩(liang)階段(duan)進(jin)行施(shi)(shi)工(gong)(gong)圖設計(ji)文件(jian)審(shen)查。建(jian)設主管部門在辦(ban)理(li)建(jian)設工(gong)(gong)程(cheng)質(zhi)量、安全監(jian)督和施(shi)(shi)工(gong)(gong)許可等相(xiang)關手續,對(dui)(dui)于工(gong)(gong)程(cheng)總承包(bao)(bao)(bao)企業自行施(shi)(shi)工(gong)(gong)的,采用工(gong)(gong)程(cheng)總承包(bao)(bao)(bao)合(he)(he)同(tong)(tong)(tong)辦(ban)理(li)施(shi)(shi)工(gong)(gong)合(he)(he)同(tong)(tong)(tong)備(bei)案;對(dui)(dui)于工(gong)(gong)程(cheng)總承包(bao)(bao)(bao)企業與施(shi)(shi)工(gong)(gong)企業簽訂(ding)施(shi)(shi)工(gong)(gong)分包(bao)(bao)(bao)(承包(bao)(bao)(bao))合(he)(he)同(tong)(tong)(tong)的,采用工(gong)(gong)程(cheng)總承包(bao)(bao)(bao)企業與施(shi)(shi)工(gong)(gong)承包(bao)(bao)(bao)企業簽訂(ding)的施(shi)(shi)工(gong)(gong)分包(bao)(bao)(bao)(承包(bao)(bao)(bao))合(he)(he)同(tong)(tong)(tong)辦(ban)理(li)施(shi)(shi)工(gong)(gong)合(he)(he)同(tong)(tong)(tong)備(bei)案,無(wu)需提供工(gong)(gong)程(cheng)總承包(bao)(bao)(bao)合(he)(he)同(tong)(tong)(tong)。同(tong)(tong)(tong)時,按(an)(an)規(gui)定做好合(he)(he)同(tong)(tong)(tong)約定的施(shi)(shi)工(gong)(gong)管理(li)人員備(bei)案。

2.對于工(gong)(gong)(gong)(gong)程(cheng)總承包項(xiang)目的樁基(ji)工(gong)(gong)(gong)(gong)程(cheng)先行(xing)施(shi)工(gong)(gong)(gong)(gong)的,符合施(shi)工(gong)(gong)(gong)(gong)許(xu)(xu)可(ke)條件的,建設主管部門允許(xu)(xu)先行(xing)辦理施(shi)工(gong)(gong)(gong)(gong)許(xu)(xu)可(ke)證(zheng)。在辦理樁基(ji)工(gong)(gong)(gong)(gong)程(cheng)施(shi)工(gong)(gong)(gong)(gong)許(xu)(xu)可(ke)時(shi),可(ke)容缺建設工(gong)(gong)(gong)(gong)程(cheng)消防設計(ji)(ji)審(shen)核意(yi)見(jian)書(shu)和人防審(shen)核意(yi)見(jian)書(shu),但必須提供建設工(gong)(gong)(gong)(gong)程(cheng)規劃許(xu)(xu)可(ke)證(zheng)或規劃部門出具(ju)的該項(xiang)目建筑設計(ji)(ji)方案審(shen)查意(yi)見(jian)。

3.在辦理施(shi)工(gong)(gong)(gong)(gong)圖審查、工(gong)(gong)(gong)(gong)程(cheng)質量安全監督和施(shi)工(gong)(gong)(gong)(gong)許可(ke)等相(xiang)關(guan)手續時,如沒有相(xiang)關(guan)欄(lan)目填(tian)寫(xie)工(gong)(gong)(gong)(gong)程(cheng)總承包(bao)信息的,可(ke)在備注欄(lan)中注明工(gong)(gong)(gong)(gong)程(cheng)總承包(bao)企業(ye)名稱(cheng)及項(xiang)目負責人姓名;其他欄(lan)目按照各勘察、設計、施(shi)工(gong)(gong)(gong)(gong)企業(ye)實際(ji)承擔(dan)的工(gong)(gong)(gong)(gong)程(cheng)內容填(tian)寫(xie)。

4.建設(she)主管部門對工程(cheng)總承(cheng)包(bao)(bao)項目中實(shi)際(ji)承(cheng)擔施(shi)(shi)工任(ren)務的企(qi)(qi)業開展建筑施(shi)(shi)工企(qi)(qi)業信用(yong)綜合評價。建設(she)主管部門在對工程(cheng)總承(cheng)包(bao)(bao)項目實(shi)施(shi)(shi)監(jian)督管理(li)時,除建設(she)、勘察、設(she)計、施(shi)(shi)工、監(jian)理(li)等(deng)五方主體(ti)外,應將工程(cheng)總承(cheng)包(bao)(bao)企(qi)(qi)業及其(qi)項目負(fu)(fu)責(ze)人(ren)作(zuo)為工程(cheng)建設(she)責(ze)任(ren)主體(ti),納入建筑工程(cheng)責(ze)任(ren)主體(ti)項目負(fu)(fu)責(ze)人(ren)質量(liang)(liang)終身責(ze)任(ren)追究辦法監(jian)管范(fan)圍,在法人(ren)授權(quan)書、質量(liang)(liang)終身責(ze)任(ren)承(cheng)諾書、永久性標牌、質量(liang)(liang)終身責(ze)任(ren)信息表(biao)中增(zeng)加工程(cheng)總承(cheng)包(bao)(bao)單位(詳(xiang)見附(fu)件1-4)。

5.審(shen)(shen)計(ji)部門依法獨(du)立開展(zhan)工程總承包試點工作(zuo)的(de)審(shen)(shen)計(ji)監督,根據工作(zuo)進展(zhan)情況適(shi)時(shi)安排審(shen)(shen)計(ji)。

對(dui)于(yu)非政(zheng)府投(tou)資的(de)房屋建筑和市政(zheng)基礎設施(shi)工程(cheng)項(xiang)目采用工程(cheng)總承包組織(zhi)方式的(de),以(yi)上(shang)試(shi)點措施(shi)可以(yi)參照執行。

五、工作保障

(一)加強(qiang)組織領導(dao)。省住建(jian)廳成立全省工程(cheng)總承包試點(dian)工作指導(dao)小(xiao)組,協(xie)調(diao)解(jie)(jie)決(jue)試點(dian)工作中(zhong)出(chu)現的(de)困難和(he)問題,健全完善工程(cheng)項目(mu)建(jian)設(she)(she)監管(guan)機制。各設(she)(she)區市(shi)建(jian)設(she)(she)主管(guan)部門要加強對試點(dian)工作的(de)組織領(ling)導(dao),建(jian)立相(xiang)應的(de)工作機構,指導(dao)工程(cheng)總承包試點(dian)各項工作,著力(li)研(yan)究(jiu)和(he)解(jie)(jie)決(jue)試點(dian)過程(cheng)中(zhong)出(chu)現的(de)問題。

(二)強(qiang)化協(xie)調溝通。各設區(qu)市(shi)建設主管部(bu)門要加強與當地政府和監察、發改(gai)、財(cai)政、審計等部(bu)門的(de)協調溝通(tong),爭(zheng)取政府和相關部(bu)門對(dui)工(gong)(gong)(gong)程(cheng)總承包試點工(gong)(gong)(gong)作(zuo)的(de)支持(chi)和幫助(zhu),確保工(gong)(gong)(gong)程(cheng)總承包試點工(gong)(gong)(gong)作(zuo)取得實效。

(三(san))優化監管流程。各(ge)設(she)區(qu)市建設(she)主管(guan)部門要從有利于工(gong)程(cheng)總承包(bao)推行的角度出發,大(da)膽改革創(chuang)新(xin),優(you)化(hua)招投標監(jian)督、施(shi)(shi)工(gong)圖審查(cha)、合同備(bei)案(an)(an)、質量安全監(jian)督、施(shi)(shi)工(gong)許可、工(gong)程(cheng)竣工(gong)驗(yan)收備(bei)案(an)(an)、城建檔案(an)(an)移交等環(huan)節的管(guan)理制(zhi)度和流程(cheng),為試點項(xiang)目的順(shun)利實(shi)施(shi)(shi)創(chuang)造條件。

(四)加強信息報送。各設區(qu)市建設主管部門要及時總結(jie)試(shi)點經驗(yan),收集整理試(shi)點工作相關(guan)信息(xi)并(bing)及時上(shang)報省住建廳(ting)建筑(zhu)業(ye)處。
